The Third Circuit Court of Appeal has directed Lafayette District Court Judge, David Smith, to hear evidence and witnesses in city-marshal Brian Pope’s bid to suppress the emails originally obtained by the independent newspaper in its case against the marshal.
It was LCG’s production of those emails from a server it operates that ultimately led to the five felony charges Pope is set to go on trial for later this month. This comes after pope’s attorneys filed a motion Monday, seeking to have his trial moved out of Lafayette due to so much publicity of his case. No date has been set for that hearing.
“We would like to show the judge that they were obtained illegally and if they were, they would be suppressed and they can’t use those emails against Marshal Pope in this trial because they were obtained illegally,” said, John Mclindon, Marshal Brian Pope’s Attorney.
